This document regulates the conditions governing the use of the website www.naturcode.eu and the provision of services therein. For the purposes of these Conditions, the activity that Naturcode Smart Label S.L. carries out through the Website comprises the development and maintenance of a smart labeling platform for agri-food products.
In addition to reading these Conditions, the User must read the cookie policy, the privacy policy, and the code of ethics before accessing, browsing and/or using this website.
By using this Website or by making and/or requesting the acquisition of a service through it, the User agrees to be bound by these Conditions, by the cookie policy, by the privacy policy, and by the code of ethics. 2. The User
The condition of User is conferred by access, navigation and use of the Website. 4. Purpose
These Conditions are intended to regulate the contractual terms for the provision of the Services, as well as for their utilization by the User and the compensation due to Naturcode.
The provision of the Services will be carried out by Naturcode through the procurement, provision, organization, employment, and management of the technical, human, and operational resources necessary for this purpose and, where appropriate, in consideration of the prices in force at the given point in time.
The commercial conditions of this service and the offers that may be carried out by Naturcode always appear on www.naturcode.eu, so they can be consulted, filed, or printed.
Naturcode provides Users with various smart labeling services for agri-food products.
The content and scope of the services are governed by each individual contractual agreement. Furthermore, these are limited to the service functionalities described in www.naturcode.eu.
5. Conditions of Access
Access to the Naturcode portal is free and confers to whoever performs it the condition of User, regardless of the subsequent use of the services offered.
The User must register to be able to access premium services (in the case of consumer Users) or business services (in the case of non-consumer Users). This is done by completing a form, which will involve the creation of personal credentials consisting of a unique identifier (which will be an email address) and a password, whose conservation and custody will depend exclusively on the User, who must therefore protect them with due care and diligence. A User will not employ credentials other than their own, with the objective of impersonating other Users in the utilization of www.naturcode.eu.
Access to the services at www.naturcode.eu may only be done by Users over eighteen (18) years of age.
The breach or violation of any of these Terms will result in the immediate cessation of access to the Services.
6. Prices
In the case of Services offered for a fee, the prices of those Services, as well as the conditions and respective forms of payment, will be indicated in the offers, quotes, contracts, and/or invoices provided by Naturcode.
Prices may be changed and published by Naturcode periodically.
7. Customer Service
Naturcode offers a customer service to Users so they can ask questions, manage their claims, request guarantees, or cancel the service.
All Users can direct their claims, complaints, or requests for information to the Naturcode Customer Service by sending an email to info@naturcode.eu.
All questions, and especially the complaints and suggestions, will be attended to as quickly as possible, without exceeding in any case the deadlines established by current legislation.
Likewise, all Users will receive written proof of them, either on paper or on any other durable format.
8. Guarantees
In accordance with the Spanish Royal Legislative Decree 1/2007 of November 16, 2007, on the protection of consumers and users, Naturcode undertakes to provide services in accordance with the contracts signed, and to respond to any lack of compliance.
9. Disclaimer of Warranties and Limitation of Liability
Naturcode does not guarantee or assure that the use of the Service will be uninterrupted, punctual, secure, or error-free. It does not guarantee that the results obtained from the use of the Service will be exact or reliable, nor does it guarantee the results expected by the User. The User accepts that Naturcode may occasionally suspend the Service for indefinite periods of time, for maintenance and updating without prior notice. It is the User’s responsibility to update and modify all the information related to their User account, including (for non-consumer Users) the information on products intended for consumers. Naturcode will be responsible only if an injury or damage is a consequence of its own malpractice and not due to interference by third parties, the User’s misuse of the tools provided in the platform, or the misuse of the labels and codes provided to them. The User must employ only the labels and codes provided by Naturcode, not any others designed to replace or amend the originals.
10. Intellectual Property
Naturcode has the ownership or license over all intellectual property on every part of Naturcode, the Service and its contents. Users do not have any right to reproduce, duplicate, copy (by any means), sell, resell, or exploit any part of Naturcode, the Service, or any content on www.naturcode.eu, without the express written permission of Naturcode.
11. Accuracy, Completeness, and Timeliness of the Information
It is the sole responsibility of the Users to ensure and maintain at all times the veracity, accuracy, and timeliness of the information offered through Naturcode. This site may contain certain historical information that is not necessarily current, in which case it is offered for reference only. We reserve the right (but have no obligation) to modify the contents of this site at any time.
12. Protection of Personal Data
Naturcode Smart Label SL is the entity responsible for the processing of the Users’ personal data and, therefore, informs them that their data will be treated in accordance with the provisions of Spanish Organic Law 3/2018, of December 5, 2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPD) as well as of Regulation (EU) 2016/679 of April 27, 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free circulation of these data. 13. Applicable Law
These general conditions are governed by the Spanish Law. The parties submit to the courts and tribunals of the User’s domicile for the resolution of conflicts, at their choice and renouncing any other jurisdiction.
